This Guy(who I am friends with) sent me a new photo of his "thing" . Me and him are both under the age of 18. Could this count as child porn? cause I seriously don't want to get like in jail illegally. Also he did it at his own will, over a txt message. I know he's stupid, but I just want to know if I could get into trouble for this? and I didn't show him anything of my body
You can't get in trouble for it, and its kinda in a weird legal place. He could get in trouble for sending lewd material to a minor and for sending child porn, but most courts don't really prosecute people under 18 for stuff when the other person is under 18 also. Its different in every state but yeah...your in the clear totally, even if you weren't 18 you still couldn't get in trouble because you never asked for it.
Child porn is being involved with sexual things that has to do with an adult (18 or over) and a minor (under 18). Since you were both under 18 this wouldn't be the case. Consensual sending of nude pics isn't taking advantage of anyone either. So this would be very borderline and would take a major complaint by you before anyone would be prosecuted since it was HIM that SENT the pics. That's my take on this question.
No it probably couldn't. There was a case here in ohio recently where a girl who took nude photos of herself was charged under child porn laws. But most people agree the charge was ridiculous, and it is expected to be dropped.
