Actually, it's the same thing exactly, but if you steal the CD from the music store, you'll get arrested unlike downloading it from the internet.

  • You steal from a store and you rob the store owner of his profit and what he paid for the cd and from the artist and record label. It has more people affected by stealing an actual hard copy.

  • A CD is a solid piece of material which took a significant amount of resources to mass produce, distribute, and burn the music onto the disk. It is far more costly than uploading a song digitally (which is essentially free to do in the first place and what many artists do anyway). So no, it's not the same, you may say they are both wrong but one is less wrong than the other.
