Can I get my rapist locked up?

A few weeks ago I was raped, 3 days after the rape I told the police and I went hospital did a rape kit and had to give all the clothing I was wearing when he raped me for evidence, my rapist was arrested but now he's out on bail and I'm waiting for my evidence to be examined and come back. The police are asking me to do a video interview and repeat everything that happened on that day so it can be used as evidence in court, I don't want to do this interview because I don't want to even think about what he did to me let alone have to say it all again and knowing there's cameras around me it would make it harder for me, if I refuse to do this interview can he still be locked up or would the court let him go. One thing that made me wonder was 9 men in my area got arrested and locked up for raping girls since 2012, the girls who were raped opened up just recently and I was thinking these men got arrested and locked up so easily so why can't my rapist get locked up, i know every rape case is different but it just caught my attention. What do you think?

  • The DA has to make tough decisions all the time. Even though they completely believe you were raped, they have to be able to PROVE, IN COURT, that you were, and they have to do it with only evidence that is admissible. Under certain circumstances, the defense can get some evidence thrown out, etc.

    If the DA isn't confident that he/she has the evidence they need to win a conviction, they usually won't prosecute, which means the guy will go free. At the very least, you've started a paper trail on the guy, so there will be a pattern of behavior established if he does it again. But there's a decent chance that without your testimony, he'll get off. I know that's horrible, but it's the reality. Our justice system must give the accused the benefit of the doubt, and it's up to the prosecution to prove, beyond a reasonable doubt, that he's guilty. That requires evidence - and the more, the better.

    Juries are much likelier to convict if they've heard from the victim in her own words.

  • yes he can get locked up but more you help with evidence the more time he will get as if theirs proof he raped you and you are under age he's going to go down for satatory rape of a minor so giving that interview will help a lot but if not able to do it thats fine aswell they just need the proof he did it

  • If you do the interview than he will most likely be locked up seeing that you've done all of the other necessary stuff after the incident. I know it's going to be difficult doing that interview but know that you deserve justice for what happened to you and that by doing this it ensures that other people will not be taken advantage of by him. So my biggest advice would be to not stress out about it and if you get stressed or panic during the interview you can ask them for a break. Also, if definitely try and go to counseling if you haven the already to help you with everything you ever been going through. And know that you're not alone and you're going to get through this! <3

  • you have to have a lot of solid evidence not just the kit. plus if it was 3 weeks ago then probably not going to stick him on in jail perminantly sadly. Iv seen this b4

  • Because they were a group, and prolly had more evidence, but yea, if u dont do this video? 9/10? they gonna let him go

  • He could still be locked up, but without the testimony, the chance of him being found guilty goes down by a lot.
    Also if he is found innocent by the jury, that is it. He can't be charged with that incident again.
