The whole reason that porn is legal is because Sigmund Frued at the turn of the century proved that sexual suppression is bad. They did many studies that proved that people who are sexually starved, ie can't get a girlfriend, are more likely to commit rape and other sexual crimes. It was ground breaking. It changed the entire political opinion on making porn illegal. It was apparent. Back then when a person couldn't get a girlfriend. And went around long enough without having sex or seeing the opposite sex naked or such things. They would almost always commit sexual crimes. Because it is like a time bomb waiting to explode. If you were to go 10 days without jacking off you would be as horny as a rat in heat. Because porn used to be illegal up until the turn of the 20th century. Sigmund went around preaching his message on every street corner. Until several test over a number of years all proved the same thing. These tests continued into the 40's. That's why porn got more and more rights. So any way. That's what took place in congress and turned the argument in porns favor. This whole thing was a debate. And for many of years you couldn't make the president legalize porn.

  • Porn is an awesome, entertaining, educational asset to society. I believe if people were more comfortable with the natural form of the human body, a beautiful art work , we would all be a little more secure in our daily interactions in life. Growing up in my family home was the opposite, sex was not talked about it was for procrastination, so by 9 I began to experience erections and I was left with no guidance, I figured things out on my own. I mad sure my son was not raised in the same manner, his ability to maintain a relationship is more advanced tha mine, some scars can never heal

  • That is an interesting theory. The only problem being that it has nothing to do with the law.

    In fact, at least in the United States, pornography is not given the full array of First Amendment protections that is afforded to other media. Primarily because the original conception of the press and speech was narrowly afforded to political press and speech.

    The broader reading only came later and over time. Primarily as the notion of free speech came to be expanded to include "free expression." A much more expansive reading that developed mostly starting in the 1960s.

    In that connection, the courts - including the Supreme Court - have stated that community standards and circumstantial considerations may trump First Amendment considerations when applied to non-political speech. Thus, for example, sellers may be, by law, prohibited from selling pornography to minors.

    The reason, in general, that you get broader sales is a combination of cultural tolerance - a more relaxed, not to say libertine, view has developed - combined with the simple practical difficulties of enforcing a ban. The apparatus necessary to regulate porn would simply be too cumbersome and costly to most jurisdictions to make it worth the time and effort. This also given that the definition of porn is somewhat subjective - the famous, "I know it when I see it" standard.

    As to the final point in the question, pornography and its dissemination long came before Freud came along. To be sure, he afforded a debatable scientific rationale for its disbursement, but samples of it can be found in the art of ancient civilizations.

    Men and women are sexual beings and the human sex drive is a very pervasive force. Appealing to it and sating it then began well before Dr. Freud came along to explain why that is so.

  • I'm not sure where you got any of this, but it's largely false.

    Porn, in one form or another, has been around forever. So has prostitution, and in Freud's day, prostitution was absolutely common everywhere. And Freud didn't "preach his message on every corner" - he wrote books. Books you apparently haven't read.

    Porn, and prostitution, was outlawed in the US around the turn of the 20th Century due to religious activism - the same kind that eventually resulted in Prohibition of alcohol. And it wasn't technically legal until California vs. Freeman in 1987, when the state prosecuted Harold Freeman for making porn under anti-pimping laws, and ultimately lost and set a precedent. Prior to that, it was technically illegal, but was almost never prosecuted because of 1st Amendment protections against (non-obscene) artistic works. This is why "Golden Age" porn always had a story, characters, plot structure, etc. - so it could be defended as art in court.

    Similar cases happened in Florida and later New Hampshire, effectively making (non-obscene) porn legal to produce in those states. It's still technically illegal to produce in many states, but given precedent, those laws would not likely hold up and so they almost never make it into court.

Freud certainly explored sexuality as part of his creation of psychoanalysis, but his influence on sexuality in society was not very substantial during his lifetime - it wasn't until the 60s that he was reframed into something of an icon. This had virtually nothing to do with why porn is legal, though, and in fact, porn was outlawed during his lifetime (actual, specific state laws being passed), and were not revoked in any US state until the California case in 1987, and a Florida case in 1989. Neither case had anything to do with Freud, but were strictly based on the 1st Amendment.

    Porn is legal because why shouldn't it be? It doesn't bring harm when everyone involved is consenting. People want to see other naked. Some people like to be seen naked or are happy to get paid to be seen naked. Everyone's happy.

    Note that coercion is rape and is already illegal. I accept that it is an issue in porn but a large majority of porn is not an issue.

  • The reason porn is legal has more to do with freedom of speech and expression. That, and we've come around to the idea that it isn't for the government to decide whether or not adults want to consume it.

    I love Freud, you're not representing him well. I support porn legalization, and would point out to you that for much of American history where porn was illegal, there were brothels. Look at old maps of cities in the United States from the early 1900's. Street after street after street of bars and saloons and brothels. It used to be common for a brothel to be an American man's first sexual experience. Imagine if instead of feeling sad all your teen years and early 20's that all the girls your age like guys 5 years older, that your pops brought you to a brothel on the corner of 4th street while he went to do some business in town. That's the way America was.

New technologies were making it easier to obtain increasing the demand for it, so keeping it illegal may have been seen as the start of another prohibition. I think Frued turning into a psychological issue was just the tip of the iceberg

  • Because porn is classified as a form of entertainment and protected as speech. Some would argue it is an art. But the big thing is that everyone doing it is consensual and it causes no one direct harm.
