There is nothing in the definition of rape that has anything to do with a guy cumming; if cumming inside you was part of the definition of rape, then the non-consensual penis in the vagina wouldn't be rape if he pulled out before he came.   • Consent is consent, you have the right to say no at any time, so if you said no just before he came then technically it could be considered rape. But try to remember once he has started to cum he can't stop the spunk from coming out like a pee lol!

  • Consent did not include ejaculation into the vagina.

    It's tricky. I could see different judges ruling differently on this. Most places have rape under sexual assault laws, and that means there is less need to get into particulars. A girl can withdraw consent at ANY time. And she is essentially saying "I am giving you consent to have intercourse, but withdraw that consent before you ejaculate." If he ejaculates anyways, he is violating consent.

    If he didn't mean to, that's just unfortunate and the guy is a careless ass. If he just did it anyway, knowingly, then that is definitely a stronger case of willfully violating consent, and that's probably going to fall under sexual assault of some sort, if not rape directly.

  • Even if a girl specifies that she doesn't want him to cum in her while consenting to sex, that doesn't guarentee that he isn't going to. Its not something we can control very well. He may not be able to pull out in time.

    I think that by consenting to sex, a girl is also acknowledging the chances of him cumming inside her. Its especially her own fault if she didn't use protection. And if she did, then i don't see why this would be an issue in the first place.

    So i think in a situation like this, its best to give the accused the benefit of the doubt, and assume that he did it on accident rather than on purpose - because this is most likely the case.
