Is it rape is a guy "stealths" a girl?

By stealth I mean he is supposed to wear a condom but doesn't or takes it off during sex.

    Him cumming inside of you without your 'consent' isn't a 'form' of rape. Last I heard, there's only one type of way that someone can force themselves onto or into another without their consent. Your situation sounds unfortunate but.. let this be a lesson that unfortunately, especially in sexual situations, you've got to be much more adamant about what's okay or not okay with guys. With the alternative being your falling pregnant, at which point saying it's 'his fault' won't fix a thing.

    • Actually, rape -- in its legal definition -- doesn't always involve force. For instance, it still legally counts as rape if you get someone so drunk or high that s/he's unable to make informed consent, even if no physical force took place. (There's a reason why "date-rape" is a term.) Having sex with someone who is underage also legally counts as rape, even if the underage person was willing, because by law they're not considered capable of giving informed consent. This particular case, I'd say would not classify as rape, though similar cases have been taken to court and caused a lot of headaches for judges and juries.

  • It’s a grey area and it differs from country to country. In general, you consent to sex _with_ the protection of a condom, this also automatically means that someone having sex with you that willingly removes the condom does this non-consensual. I would file charges if I were you but be ready for a “your words against his” situation. If he can convince the judge that your condomless encounter was consented by you and you ‘seemed’ having changed your mind later on you’re still nowhere. Will be taking a lot of emotional energy all this.

    This is an offense, maybe it is even criminal in some way, I don't know the laws regarding something like this but it is in a way an assault. You could become pregnant, get a disease etc. based on his actions.
