  • If their lie did NOT result in a guilty conviction, then punish them with Slander/Libel. If the guy is sentenced to prison, the female who lied should serve time equal to what she made the man go through. She should be required to pay back all expenses, including court costs and money lost due to time away from work, as well as for pain and suffering to both the man and anyone else close to him who got hurt as a result. Also, she should be barred from any position of influence and power, both in her career and, God forbid, in the case she tries to run for office anywhere. Try to destroy an innocent life means you deserve to have yours destroyed. This is in the case of a female blatantly making up a false accusation. I do not think this should apply to a true victim of rape who just simply cannot get the rapist convicted.

  • What punishment, it truly appropriate, when she falsely accuses him? That accusation, is on his record, for the rest of his life, and biases anyone, seeing that record! It is not a simple thing, and easy to fix! He is fucked, and will face, bias, and judgment through the rest of his life. How do you make make that right, with just jail time?
    I would hope that once she was convicted, of the false accusation, that his record would be completely expunged of any wrong-doing, but any media coverage would still remain, haunting him, the rest of his life!

  • If it’s proved to 100% be false (because I can’t imagine anything sadder than a woman/man who’s been raped and then juridically punished for speaking out) then they should go to jail. It’s such a selfish and horrible thing to do.

    However - the people saying they should receive the same punishment the alleged rapist would get. Really? I get that revenge seems fair in that sense, that if the accuser was ready to give this innocent person this punishment they should get it- but sentences can’t be based on primal feelings. The severity of the two situations are so different - accusing someone of something and raping someone? One is just words, the other is forcing yourself onto someone screaming no, giving them scars for life. The logic doesn’t add up.

    • I disagree. I would say a false rape accusation is FAR worse than rape as far as damage caused. One (rape) is just a few minutes of suffering. The other (jail time from false accusation of rape) is years of suffering. Given the choice, I would much rather be raped than falsely accused of rape.

  • As an inexperienced and let's face it, naive young man, you probably only think about one side of the story. However, fining alleged rape victims is a two sided sword. If you fine women who can't prove they have been assaulted then many if not most women will think twice before reporting their assault. This will have a deterrent effect on victims. What if they can't prove it for sure? What if there is only circumstantial evidence? Will they be sued and fined on top of their horrible experience? Will they be shunned?
    If a person is exonerated they can usually file a defamation lawsuit against the person who has falsely accused them of a crime.

    • Lack of proof is different than being proven to have falsified a report. I don’t think the OP is talking about cases that lack proof... I think he is referring to more obvious “proven liar” cases. I don’t think there are many. I think it would have to be a “victim turns out to be in a different country than the offender at the time of the crime” type of cases. Again... there aren’t many cases like that. There’s usually either proof it happened, or lack thereof.

    • @Glue-Sniffer That's not what the person meant. Go read it again. They're talking about proven lies. My cousin was falsely accused of rape and sexual abuse and the girl that falsely accused barely got any punishment. She should've been thrown in jail.

If a person is raped when she was drugged or unconscious or if some time has passes before she reports it there will be no dna evidence. If she is kidnapped and raped and some time passes before she is free then there will be no dna evidence. If she hesitates because she has been crushed and is devastated from the event and needs to gather her strength begore going to the police and facing the scrunity over there, there will be no dna evidenve. There is a fine line between not being able to prove a crime and being accused of lying.

    1. A proven false accuser, like it or not, makes genuine rape victims less credible.
    2. The false accuser just destroyed a life. Even if the person is cleared, it causes psychological damage. The person, even if cleared, still is known as someone accused.
    I have an uncle in such a situation. He wound up burying himself in his work, refusing to have a social life, and does not trust any woman.

    • It was 10 years ago.. The accusation was made when in fact he was in different state on a construction site. It nearly destroyed him professionally. It’s left him with a lot of trust issues.

If the man accused of rape is found innocent, then the woman is automatically raped as punishment? You do know that false accusations are actually very few, compared to the very large numbers of genuine rape cases and unreported rapes - against women? Yeah, men do get raped, and there are false accusations, but both those numbers are absolutely dwarfed by the real rape cases. Despite what all the 'men' on GaG would have you believe. Is rape OK?

    • that was my first thought as well, but the sort of girl who falsely accuses someone of rape is more likely to be hurt more by la douleur exquise than the pain of getting their butt stretched. So, instead, they should be put in a pillory next to two sentinel "ugly chicks" who volunteer to suck the cock of any guy who passes by. Once they do so, the spit it onto the face of the false accuser. That way she gets no attention from men, but has to deal with all the messy shame from women who would normally be considered her lessers.

  • I think some countries have a criminal mischief charge or something like perverting the course of justice. Most punishment are there to be a deterrent to people in the future doing it. While causing a lot of trouble they also hurt the cause of true rape victims.
    There may also be a whole other discussion about what is sexual assault but probably leave that for another day I always welcome more clarity when it comes to the law.
