What is your opinion of Abigail Finney and the person she accused of rape, Donald Ward?

For those of you who've never heard of Abigail Finney, she was a Purdue college freshman who thought she was having sex with her boyfriend. She later found that the young man who had climbed into bed with her was actually her boyfriend's friend and she had willingly engaged in intercourse with him. Her report of the incident eventually led to a rape charge against Donald Grant Ward, who was acquitted of any wrongdoing in the February 2017 encounter.

As an update to the details: Abigail, her boyfriend, of a very short time, and his friends were hanging out in his dorm room, playing video games. She got tired and fell asleep on his bed. She's supposedly a pretty heavy sleeper. Her boyfriend had got tired and went down the hall falling asleep in his girlfriend's bed. Then one of the other guys got in bed with Abigail. He made a pass at her from behind. Thinking it was her boyfriend, she helped by inserting him. A minute later...

    If I’m rewriting the statutes I’d include a pretty strict (ie narrowly defined) deception clause and from how this is described it would qualify.

    Some guy says he works for nasa and turns out he works at McDonald’s, that’s not rape.

    In this case she was in her partners bed in the dark. As an impartial observer I think it’s clear that a reasonable person in her position would assume it was her boyfriend and a reasonable guy in the guys position would realize she’d assume that. She consented to sex with her boyfriend, not this guy.

    For the guys struggling to understand this, perhaps consider how you’d feel if you fell asleep in your gfs bed. You’re woken up in total darkness with a bj. As you’re close the woman climbs on and rides you. Briefly. You ejaculate then discover it was another girl, she’s not on birth control, you now owe decades of child support plus she gave you herpes. Is it reasonable for the court to say “oh well you consented you probably always wanted to fuck your gf’s friends you’d have checked it was really her if you’d wanted to”? No, that would not be reasonable.

  • At some point, she had to discern the bf’s friend and it would all come down her actions at that point. If she willingly went for it and felt bad afterwards then she is sick, if not and pushed him off or NO, then both males are sick. Goofy sht like that is what propagates this.
