If a tranny goes on a date with you and makes out/has sex with you, but doesn't tell you they're a tranny, should they be charged with rape?

  • That's tricky, technically it's not rape since it's consensual sex if you consider this rape then all the man who lie to women telling them they have tons of money just to get sex should be also called rape (since in the both cases there's lie).
    Too if you say this "having sex with a tranny traumatized me" then you're being transphobic.
    I'm trying to think of all possibilities but regarding the laws there's nothing that can be done in this situation.
    If you have sex with someone who have a sexual disease and he haven't said anything then you can't accuse him of rape but you can accuse him of putting your life in danger and he would go to prison for years but in the case you had sex with a tranny there's nothing that can be done since a tranny doesn't give you illness when you have sex with them and the sex was still consensual.

    • It's not so much my reasoning but more the one of the laws and also even if I personally believe people who lie to get sex should be punished you cannot punish everyone who do it (it happen too much) and then imagine if a guy have sex with a girl then leave her she could tell the police he lied to her to get sex and then say it was rape. (Like he promise her he would marry her but once she give him sex he leave her), this happen a lot with Muslim, some Muslim girls want to stay virgin until wedding but if the guy told them they would marry her she give them sex and then the guy leave them (the girls are very naive but it still will be a lie) and if we have to punish every people who do it that would take ages. ^-^

  • No, if you have sex with a transgender person, even if they didn't tell you their actual birth gender, they shouldn't be charged with rape solely because they didn't tell you. The reason is because, regardless of what they told you or didn't tell you, you still chose to have sex with that person. By that logic, that's like saying you personally only prefer sex with women 18-25, but wound up having sex with a 26-year-old because she said she was 25, and that she raped you because of this. It doesn't work that way. You still had an option to say "no" to sex regardless of the reason. Rape is when you are forced into having sex with someone. Nobody forced you to say "yes." Also, the argument that being fooled by a transgender person is a form of rape is also flawed too because it assumes that a person wouldn't have sex with a transgender person if they knew that they weren't the gender they claimed to be. First, how could the law possibly know that about a person, and better yet, why would the law care? There are plenty of people out that would have sex with transsexuals, openly or secretly. For all the law knows, YOU could be one of them. Thus, it wouldn't make sense for transgender people to be charged with rape in that regard. However, if the transgender person put a gun to your head and forced you into sexual acts, that's definitely rape and I would report that quickly.

The point is just because you had sex with someone and things didn't turn out the way you thought they did doesn't mean you were raped. Not all traumatic experiences are the result of rape.

  • Considering that the person consented to the sexual contact/act this cannot be considered rape.
    Was the trans deceptive? Yes, but this does not constitute as rape.
    In order to protect ones self from this occurring, know someone for a significant amount of time before engaging in a sexual act.
    This doesn’t stop someone from lying to you but it sure does reduce the chances of this occurring.

    • Rape by fraud would be pretty hard to prove in my opinion. It’s common to be lied to by the people you love or choose to be intimate with. With your view, everyone would be capable of filing for this rape by fraud charge. How many women are lied to about their man not cheating, having kids or a decent career and they’ve been having sex for months? How many men are lied to about the very same thing etc? With this view everyone would be pretty much considered a rape victim.

  • People who are transgender should tell because it's dangerous otherwise. People have been killed because of it. And the other person should have the right to make a conscious decision. It isn't rape but it might leave their partner confused which in some cases the man can't handle it. The fact is that the partner was turned on enough to have the sex and the only thing he can do is depart from the situation. He can go get a therapy consult if he can't get over it or he just has to let it go.

  • It's wrong but it's not rape. The sexual intercourse wasn't explicitly forced, just based on the occultation of information. By that logic, any case in which a person lies or deceives in any way could easily be considered rape too.

    Therefore we could start considering rape if you get a very attractive girl home, but next morning you discover that she's very unattractive without makeup and no way you would have fuck her if you knew. Or you discover her breast aren't natural and you dislike plastic surgery. Or she has done surgery in all her face. Or she has lied about religion, or about having experience or beign a virgin. Whatever.

    We like it or not, rape is when the victim is threaten or forced to have sex. In case of beign through threaten, their own survival is on risk and they could even die OR their only way to ear money and survive in the social system is at risk. If it's physically forced, the victim is asleep, passed out, so drugged they can't move, tied, so injured they can't move, etc.

    I understand how shocking, even traumatizing, can be to find out the woman you slept last night is not biologically so. But, unless this person drugged you, tied you, black mailed you, put a knife in your throat, or kept fucking you when you asked to stop. I'm sorry, that's not rape, more like a fraud or scam.

    As a side note, I don't consider rape the so called fraud rape. Just if there's a harsh obvious blackmail. But if someone appears from the nothing and says to me, "fuck me and I'll give you a million dollars" and I fuck him and he doesn't give me a million dollars... I don't consider that rape. I consider it a scam.

    For one thing I don't just do it casually, so I'm gonna get to know the person first. If I become sexually interested and have ANY doubts about him being an actual guy instead of a fake, I'll have him get lab work to see if he was first conceived with a Y chromosome - not born, CONCEIVED. If there was no Y chromosome involved in the conception then he's out. And obviously if he refuses lab work then he's out too.

    I'm not trying to date a fake person who isn't even happy with who they are.

    • Think: DNA records EVERYTHING that changes about you from the moment you're conceived. If your gender was changed - even the DNA - it's still recorded if you go that far back.   • There are people who completely look like a normal female, yet have one x and one y chromosome and are therefore male. No debate THEY ARE MALE. This is caused by a single defective gene on the Y chromosome. If a person with this condition chose to have surgery to make his outward appearance match who he is genetically, do you think such a person would be morally and legally obligated to share their medical history to all potential partners?

  • No because who raped who? No one was forced to do anything sexually. Trying to apply penalty to something that you feel violated you is not the right answer.

    I do think that any tranny, t-girl, TG, whatever form they are, should be up front and tell whoever is picking up on them that they are transgender to some degree. I do think that lying and not saying anything is a sure path to problems, especially if the guy is against the LGBT community.
    I have heard many stories where the guy found out the girl he picked up on and is now half naked in front of him is a t-girl, TG, tranny, whatever, and he did not know it, and then he beats the shit out of her. How many t-girls have died from that scene? It happens all the time.
    So if the t-girl does not tell her perspective lover that she has something extra, she is the one who is taking a chance or her life. And I don't have much sympathy for them then. It is fun to pretend 'you got it', but in reality, you have to be honest, or it can kill you.
