If you accidentally see someone naked, does that count as sexual harassment?

First of all, this is NOT based off something that happened, I just thought to myself that if you accidentally saw them and it was not intentional, would it be considered assault?

Plus, you didn't touch them and you weren't stalking them or trying to find a opportunity to see them naked.

If such a scenario occurred, I understand that it would be very embarrassing, but I don't think it is a sexual assault towards the person who was naked.

I want to see the number of peoples opinions and please say why you believe the choice you made as well please :)

  • I would imagine it wouldn't be counted as sexual harassment since you weren't diberately stalking someone to see them naked but rather that you were at the wrong place at the wrong time!

    It's one thing to accidently catch someone naked; it's another if you sexually assault them, take pictures of them naked without their consent and/or touched them without consent. I've heard of stories of people getting framed for sexual harrassment when the other person intentionally got naked and placed their victim in a situation where it was unavoidable to be seen together for the purpose of blackmailing and/or to get their victim in trouble or arrested.

    If you have a good heart and see someone naked accidently, be respectful to look away and pretend it didn't happen! It's embarrassing for sure but sometimes, these moments happen and it's our job to ensure both you and the other person feel safe after the incident happens :)

    First off, were they in a location where they should expect to be nude without being interrupted?

    Like are they in the changing room? Or are they just nude in public some place.

    • It is a scenario where it was incidental, so not in public. The only time a person gets naked is for 1, Showering and bathing 2, Changing clothes 3, Sexual interaction 4, Medical examination So we can say that of these 4 that they were a scene where the person did not want to be seen when naked and an outsider accidentally saw them. Were they located in a area that they shouldn't be interrupted while naked, I would say that if 1, bathing or showering in a private area as opposed to mix bathing 2, changing clothes in their room and someone comes in 3, Sexual interaction they were trying to keep it between the two of them and someone saw 4, Medical examination I feel like I can't make a scenario for this one

So the thing with a lot of the sexual assault laws is they take into account the feeling or perception of the victim and not the intent of the alleged assailant. So if the jurisdiction in question has a system in place like that. A crime may have been committed even if the person committing it had not intention of doing so, provided that person was negligent in their actions and as a result the issue occurred. But that is the way a lot of laws work. It doesn't matter if you intended to commit the crime. But they also usually have a lesser sentence, take 3rd degree murder, or involuntary manslaughter. That's way more extreme than "he saw her boobies" but it gives an idea about how the logic works.

  • No, and you should know that sexual harassment and assault should not be used interchangeably. In this situation you were not a harasser because you didn’t mean to do anything sexual. But the naked person would be harassing you if they intentionally put themselves in a place where you would see them naked even if you didn’t want to.

  • I would say no unless the person walking in deliberately did so or went into a place that they were bound to find someone undressed such as a dressing room. Accidents happen.

  • They should immediately make an effort to look away or cover their eyes. When I was a kid, I was changing to go to the local swimming pool. I already had my shorts on, but other dudes were butt naked. A lady walked into our changing room, without a care in the world, just strolling by (I think she was looking for some one, maybe her kid). But what the hell? Not even an apology.

    • I know what it is, you need to remember that I am the one who DOESN'T believe it is sexual harassment but rather am asking because I have come across people who do believe it is, so I am asking people online what their view on the matter is.
