With rape you are forcing someone to do something they do not want to do. With cheating you are doing something of our own choice that someone else ( i hope) would not want you to do.
Adultery used to be illegal in many states and we were a much more moral country then. I mean instead of the 10 commandments it will soon be the 10 suggestions.
because in cheating it's still consensual sex , just with someone who's not your partner but it is still not forced on either of the party
Rape is when the other person doesn't want it and you are forcing them to.

That's a good question. It would be nice if it cheating was illegal. Among so many other reasons, cheating puts the partner at risk of getting an STD if they think they're in a monogamous relationship but really aren't.
Because rape is when one's body is penetrated without consent.

Both are illegal in my country. Fornication is the proper word for cheating. Just talking to someone other than your wife doesn't automatically mean it is cheating
In cheating, both parties consent to sex. Sex between two parties, regardless of their relationship, is legal. Rape is when one person did not consent.
Because this isn't a heavily religious country like it once was.
