Do you believe people should have the right to use lethal self-defense against someone who's trying to rape them?

Question inspired by a TV show.

In real life, do you believe that a person should have the right to use lethal self-defense against someone who's trying to rape them?

  • I absolutely agree anyone being raped whether male or female should have the right to defend themselves at all cost to their attacker
    many forget that the attacker made their choice to do what they are doing before they decided to act... and then sealed that decision with action which will last with their victim (s) for a lifetime... and some cases where a child is created from that attack, more than 1 lifetime... it also effects those around the victim too

    I trained my last girlfriend to incapacitate any attacker in non-lethal and lethal ways, with efficiency, speed and effective force so that if anyone attacked her for whatever reason... she would be ok whether i was there or not... and the student became scary in how good she was... i actually pity anyone who attempted to attack her tbf...

    infact a guy in a bar while out with work colleagues at a leavers night out... attempted to grope her...
    she pushed him away and told him to leave, he tried again... she broke his nose, he tried again... she put him down... he got carried out...
    and without breaking a sweat

    in my eyes, self defence, and i was proud of her even more

    • just what i was taught over the years i used to train and even teach students as a junior instructor in freestyle mixed karate so what i've learned i taught in a face to face... i've never tried teaching any student over video or use pictoral examples though but anyone can achieve the skills just takes time and patience in building up muscle memory start slow, then build up speed for accuracy, speed and power... she was quite angry over the years so she had a lot of aggression in her to put the power behind her strikes... however i've taught some who used to cry at their own shadow

    You're allowed to use lethal self-defense if someone is breaking into your house in most areas. You're allowed to use lethal self-defense if you can justify fear for your life in any sort of confrontation (though this is harder to prove).

    So why not be allowed to use lethal self-defense in rape?

    The problem is, is 8 or 9 out of 10 women don't have the know how to kill a person anyway. Never mind the strength or proper self-defense to escape/give themselves the advantage to *do* anything. I personally am former military. I may only be 5'3" but I am quite dangerous. I know how to seriously harm or even kill someone unarmed.

    Never mind almost as many women lack situational awareness/intelligence. There are women who'll walk down dark alleyways to a parking lot by themselves, there are women who'll walk in a parking lot after hours by themselves (instead of asking a colleague or security if available to come with) though their vehicle is hundreds of yards in a poorly lit area, who'll walk in a heavily wooded/overgrown park setting by themselves in the early morning/later afternoon hours, who'll go to a pub/club & get hammered without asking their friends to take them home instead of wandering off with the first guy that buys them a pint, etc., etc., etc. that blatantly put themselves at risk of being raped.

  • Yes, and in any situation wherein they're being assaulted. And it doesn't matter what gender the victim or assaulter are - self-defence ought to be permissable no matter how you identify.

    Lethal self-defense should be allowed and defensible in my mind. Something that would be held against the attacker more than the victim.

    However, that does bring some questions to the table. It does open a possible loophole for false victims to effectively murder and get away with it - though I would hope they'd have a hard time.

    But guaranteed, if someone attempted to rape me, and I couldn't figure out a way to stop them short of lethal force, I'm going for a kill. And hopefully coming just short, but honestly I probably wouldn't be thinking past "get out, get help, stay alive".

    Should you be able to defend your self and potentially best the crap out of them? Absolutely...

    But if people are going to complain about a cop using lethal methods to stop ba criminal then you shouldn't be able to do the same...

    That being said... You ARE allowed to use lethal methods of self defense... If you killed an attacker then you'd go to court for murder... And they would let you go under the guise of it being self defense... So... I don't know what your asking...

    I also think there's a difference in self defense and shooting a guy who wronged you. Essentially... Are you shooting him to prevent him from rapping you... Or are you shooting him cuz you pissed at him for trying...

    I also think that death should be avoided at all costs and in most cases it can be avoided... So personally no... I don't think anyone should be allowed to use lethal force... Not just specifically in this situation but in general.

    Unfortunately life dosent work that way and lethal force is called for out used more then it should be...

    But you just asked my personal opinion, not how things actually work

  • If we're talking about guns, I don't think it would normally slide if someone just whips out a gun and shoots to kill. However if I was to put myself in the victim's position, we're talking shock, being terrified.. And I would be doing anything I could to get them off me, whether it risks their life or not.

    If we look at the US, if we say people have the right to use guns to defend their property, they sure as hell should have the right to use guns to defend their body.

  • Absolutely. Self-defense is a right, and rape is a major violent felony. Most states in the US recognize this and self defense is an affirmative defense. The few states that don't recognize this right are run by the same people who won't shut up about how much they care about women's rights. Oh, the irony...

    • Mad idea what if just think now, not all women speak the truth and what if they want to use the law to get away with things, I mean men been doing to women for ages but does it make it right to then allow them too? And if it's a problem in a area did they do it for that reason, I mean I can guess I dont know for sure..

  • I liked the phrasing of C, too hard, heh, it's true though. Unless you have trauma to show for yourself and it's in your own home you'd have a hell of a time proving it was non-consenual.

    It matters quite a bit as prosecutors are there to prosecute, and police are working at the direction of prosecutors and elected officials. That dead body better be guilty as all hell, or someone has to pay for how it got dead if you're getting the cops involved.

    That would actually work much better in stand your ground states as you don't have to provide many answers for bodies you may leave behind. Anywho, this video may help.

  • It would be too hard to prove, but in theory, if there were some way to enforce it, I'm not against that. In fact, I'm not against the use of lethal self defense if someone tries to mug you or anything of the like. The only problem is being able to prove all of that and not let innocent people die.

  • No for a few reasons. First just look how often you see questionson here like "my boyfriend put his hand on my bum did he rape me?" Do we really want to give these women the right to kill? Secondly rape does not carry the death penalty, if a judge can't pass that sentence why should an aledged victim. Finally its impossible for a dead man to defend himself in court, women could kill at will and claim selfdefence

    • A judge passing that sentence is an act of retribution. An act of self-defense is simply a matter of protecting oneself, not retribution.

  • Of course. If you are trying to destroy some ones life you have implicitly agreed that they are allowed to do what ever it takes to stop you. Its like going into a ring then acting shocked when the other person is fighting back, you don't get to complain that some one beat the shit out of you if you threw the first punch. A person should not have to allow themselves to be raped because a bad persons life is more important then the victims, thats insane and that is the exact opposite of justice.

  • I believe in "Instantaneous Destructive Force" for Street Self Defense, so Yes, I believe a person should be able to kill in self defense, especially a woman being raped by a man. Throat Jab the bastard over and over until he chokes to death.

  • It's legal. You can use lethal force in a situation where you or someone else is in risk of great bodily harm, or rape.

  • Well self defense is a thing and rape is a form of asault now I'm not saying any woman who walks into court claiming she killed a rapist should be free to go because there's always the possibility she murdered a man and claimed to be raped to get away with.

    But just like self defense in normal cases you need to prove self defense and not just say it.
    So yeah technically self defense is only valid when the perpetrator makes an attempt on someone's life.
    The law should stretch to include someone's genitals basically. So if you attempt to rape but not kill the victim is still allowed to use deadly force
