  Of course it can. We either hold both sexes responsible for their choices and actions when drunk, or we hold neither responsible. Your question is moot until society begins to treat both sexes equally under the law. Until then, your question is irrelevant compared to the issue I raise.

  No, it is you who misunderstands. It's a matter of principle. If you claim women are not responsible for their bad decisions and actions while drunk, and therefore a man who has sex with them during that time is guilty of rape, you CANNOT then turn around and also claim a man who makes a bad choice while drunk is responsible for his actions and guilty of rape. If you don't see the problem with that then you are not very bright.

  Rape is not the core issue here. It's the principle of one sex being held to a higher standard than the other. It's the fact that society and the law believe that women are not capable of making a decision while drunk, but men are. It's the fact that that double standard results in men going to jail on both side.
