  • You can sue anyone for anything, but that doesn't mean your lawsuit will go very far. I'd STRONGLY imagine that the release you sign before doing your scene (and which you are required to sign before working, and certainly before getting paid) will include some kind of language that protects the producers from such suits with STDs being considered a "hazard of the trade."

    California law requires performers to be tested for major STDs (HIV and others) a minimum of every 30 days, and many major studios require testing every 14 days, but there are fly-by-night porn studios who likely ignore the rules and do whatever. The big studios have too much to lose, and so they're sticklers for the rules, and most experienced porn actors won't work outside of that, but some newbies do. Experienced porn actors rarely have sex with people outside the network of performers for STD reasons, but there are always a few exceptions.

    The last big scandal was about 10 years ago - a porn guy went to Brazil for several porn shoots - including a couple of Brazilian productions - and those companies were doing testing, and he got HIV and brought it back to the US and infected at least 1 and probably 2 porn girls in the US. That resulted in a big clamp-down on performers working out of the country - they now have to have multiple clean tests over time before they can work after returning from overseas.

  • No; you'd likely have to sign paperwork and waivers before anything ever even remotely got that far. However, they could potentially sue the other person if they lied about their health and transmitted an STD to the adult film star in question.

  • this is just my understanding and by all means could be wrong. I think that it depends on a few things. If something was sighed saying that they are not responcible for any health checks or tests and thus are not responsible for any STDs recived during the making of the movie, then I would have to think no they can not be sued. If nothing was sighed or told then maybe. I personally think that this would be hard to sue over becomes its common knowledge for people working in the adult movie industry that STDs can happen and how to prevent them.

  • Of course. That's a crime. Unless it's been stipulated beforehand and you've agreed to it, then there might be an exception and a way around it. I highly doubt it though because that's grievous bodily harm.

  • Generally no because you sign a liability waiver or a release from liability as part of your contract but there are rare occasions where it could be overridden.

    • Right. I’m sure somehow it’s possible to spin it to make causation, but it’s not really an actionable claim. I’d be surprised if it survived a 12(b)(6) motion.

  • There are no STDs in porn. They get checked every 14 days. And if they find out you have one, you’re out of the business. They haven’t had an outbreak of STDs in several years. So it’s very unlikely to ever happen if you were in porn. But in the small chance you did happen to get one from another porn star, I have no idea if you could sue them.
