  • if she didn't say no and the guy had no means of knowing "she didn't want it" at the time they had sex, it was not rape.

    if you can't act responsibly when you're drunk, don't drink alcohol. don't blame your irresponsibility on a guy. unless he filled you up against your will with the predatory intend to fuck you against your will, it was not rape.

  • If one of them was drunk and the other wasn't, I think you can. I'm not sure if they were both drunk. Either way, unless you have clear evidence they were drunk at the time, I imagine it would be hard to convince a court.

    • @genericname85 Not correct. The law does not see it that way. In the eyes of the law, consent can only be given FOR SEX when both parties are sober. That has nothing to do with drunk driving. In the case of drunk driving, the drunk made the choice to drink and then lost control and put lives in danger. In the sex case, the sober person knew the drunk was intoxicated and took advantage of them. It is extremely ignorant of you to make the response you did and shows you lack common sense.
