All Rape is Non-Consensual Sex but not all Non-Consensual Sex is Rape.

What are your thoughts about the above statement?

A husband who fucks his wife without her permission while she is washing dishes, a woman waking up her husband with a blowjob & then fucking him...
This is Non-Consensual Sex.
Do you think this is Rape?
Would you send your husband/wife to jail for being too horny?
Would you send your husband/wife to jail for trying to spice your sex life?

I think you are confusing implied consent with non-consensual.

If my girlfriend says, "can I wake you up in the morning with oral sex," and I respond, "yes, of course, please!" then I have given explicit consent. The next morning, she delivers on her promise and I tell her how wonderful that was.

The next morning, she doesn't ask me in advance. She assumes that I like it and she can do it again. And she does. And I do like it again. This was not non-consensual sex. It was sex with the consent implied from our previous conduct.

If you have sex with a person and you do not have either express or implied consent, then that is non-consensual sex. There may be instances in which you would say that the non-consensual sex did not meet your conception of rape, but in my jurisdiction, non-consensual sex is define as sexual battery and is punishable as a serious crime.

Sexual battery, in Florida, is the "oral, anal, or vaginal penetration by, or union with, the sexual organ of another or the anal or vaginal penetration of another by any other object; however, sexual battery does not include an act done for a bona fide medical purpose." That means that if you touch another persons anus with your finger, if you place your penis in contact with a girl's vagina (even if there is no penetration), then that is a sexual battery. . . unless, of course, you had either express or implied consent.

If a person says "No" it's non-consensual. Rape is absolutely non-consensual. Rape is horrific and traumatic.
But a husband coming up behind his wife while she is doing dishes, lifting her skirt, and fucking her without express "permission", or a man waking up in the morning to find his wife sucking his dick aren't non-consensual acts unless the person protests and is forced. Consent doesn't have to be verbal. People consent to sex all the time without express verbal permission. Body language speaks volumes.

There is no such thing as "non-consensual sex". If not everyone involved consents, then it's rape.

Within a relationship you would have a certain amount of implied consent, so if guy approached his partner from behind and start initiating sex she may not explicitly consent verbally but through previous actions and conversations it is implied that she is OK with it, and if she wasn't she would tell him no. Same with the other scenario, he hasn't consented but she is relying on previous actions to infer that it's OK. If he was a friend staying the night in the spare room and she woke him up doing that, with no consent, the it would be a sexual assault.

Depends how hot the violator is usually. Don't think many women, or maybe men too, would be screaming rape if Brad pit was pulling off their pants without consent and spitting on his rod. But if old fat smelly Billy Bob with missing teeth and full of dirt would do the same, they would be mortified.
