Is this really a sexual harrasment?

I read it on news.

An 18 year old girl went to tattoo parlour for a low waist tattoo. It was a private room. He asked many sex related questions and asked her to lower the pant. There was a needle on her back and she thought he asked it for tattooing. She lowered her pant, he then fingered her and pulled her panties down and had sex.

She said, she didn't knew what to do. She went home and cried. Then filed case against him. The guy got arrested.

Is this really a sexual harrasment?

She said she had a needle on her back so was afraid and couldn't react. Do you think the guy held a needle on her back during this entire incident?

  • I think we need more info to make a good assessment.
    Did she say no did she give any signals that it was unwanted.. we don’t know.
    The idea that he held the needle to her the entire time is a little absurd but it could happen…the fact is she went for a tattoo…not sex…it shouldn’t have happened but we will see what the courts decide.

  • What you are describing is not sexual harassment, it is rape. She did not go there to be fingered and f**ked. She went for a tattoo.

    If he wanted to do all that then he gets her permission, punches out on the clock and takes her home or to a hotel.

    It sounds more like she may have given him permission but then had remorse after and may be making up a story. In either regard he should have done it the way I am saying to protect himself and remain professional.

    There was a chiropractor in our town that did a similar thing. He told the girl to take off all her clothes and put on an examining robe and did about what you are describing to her. He lost his license and went to prison.

    • Do you own a firearm? Honestly I think women have better life or death judgement than men in most cases and you don’t need to be athletic to place a pistol on target. I’ve heard of active shooters downing a female cop and her returning fire from the ground as he approached her and killed him, another female security guard maneuvered through cover and flanked a gunman armed with an AK style assault rifle at a nightclub shot him in the leg, secured his weapon, and then provided medical attention

    • As I said you need to educate yourself about rape. Laws in majority of countries are based on consent. Force is only used in a few countries and even then they are reviewing their law to make it consent based.

  • I can't believe some of these responses, especially from some of the women here. I can't believe people are really saying "did she say no? Did she say not too?" Are you fucking kidding? It's called affirmative consent people, you need permission, you need a yes. She didn't say "stick your finger in me" and he didn't ask "can I stick my finger in you?"

    The lack of "no" isn't fucking consent, this isn't a gray area, it's not confusing, if you don't have permission you don't fucking do it, and if you do you are a rapist.

    The unsolicited sexual talk was sexual harrasment, as some as he penitrated it turned into rape, further more it's an abuse of power and I'd assume a direct violation of some sort hypocritical oath.
    People whos profesion requires working on or around naked people are held to a hire standard than normal people, he should get in more trouble, this isn't just some handsy perv on a date, he's suppose to be a fucking professional, no one is allowed to fondle body parts just cause they saw body parts. There's no excuse, if a tattoo artist needs to get ink somewhere that a private part is in the way of he'd either need to inform them that he's going to move it with his hand before doing so to see if they are OK with it or more likely ask the customer to hold it to the side for them while they tattoo the area.

    If it was withdrawn consent or later regret he committed the ultimate sin in entering a room alone with a women (these days you might be okay with the over 50's but under that have a camera with relevant permissions or a witness as the less preferred option in cases like this)
