K. Well it would depend on the drug, or it should at least. Several "drugs" that are currently illegal shouldn't be, in which case no, they shouldn't. But the illegal ones that should stay illegal because they're too dangerous for anyone to use-- like heroin or Fentanyl-- yes, the deal can and should be charged. However, the charge wouldn't be, or shouldn't be, murder; it would be manslaughter, probably even second-degree.
If you don't mind me asking- what got you started? One of my uncles is pretty established, and I just found out her was a heroin addict for a couple years in his 30s. I literally would have never guessed. It started with an addiction to pain pills that were prescribed.

I didn't say I agree with it, it happens all the time.
If the dealer sells you fentanyl laced drugs they can get charged with murder, or attempted murder.
