Okay, here's a question, Why does a mother that kills her own baby get less time than the father who was a part of it but didn't kill the baby? Personally I think the mother should get life or more time than the father unless the father was the one who killed the baby.

Update: No, I'm not referring to any particular story, I'm just taking a Law class and I just don't understand why the women gets less time than the man.    7 months ago

Update: Say the birth mother killed the baby with her own hands and the father was there but didn't do anything, the father gets more time than the mother.

I think its because they take into consideration that the women Must of had some kind of post natal depression at the time which in my opinion is no excuse for killing your own baby

Um, I don't think the laws are set up that way so I'm not sure what you're learning in "law class. " I know there is nothing about gender in the statutes for murder, or sentencing guidelines.

That said, society in general can come down harder on men than women for similar actions. Including the courts. It's kind of based in tradition and experience, where women are more likely to be perceived as "unhealthy" and needing help vs. Men being perceived as "criminal" and needing punishment.

Not 100% fair, but men did kind of earn our status as the more violent, criminal, abusive, dangerous gender, that's not fiction. So people are more scared of men, and more "hard" on men who screw up in general. So the system errs on that side of judgment on occasion.

Because men as a gender are more dangerous, and juries and judges are human and sympathies play a part in sentencing.

I can't remember a case, but I do remember Warren Farrell (author of "The Myth of Male Power") coming up with some examples in an interview.

Both of them should go to prison for life they're equally guilty! The law is so dumb sometimes it doesn't make a difference if your a male or female if you killed someone then you killed them and need to go to prison! What do women kill softer then men is that why the get less time? or does the victim not matter as much? They need one set penalty for all killers in my point of veiw!
