A car on the shoulder of the highway has its driver door hit by a passing car, whose fault is it?

Just as the questions states.

A conversation I had reminded me of an incident years ago where I passed a taxi that was stopped on the side of the highway. The taxi's driver door had been hit by a passing car, most likely the one in front of me, so who would be at fault in such an accident? The taxi driver or the passing car? Assuming the passing car was in their lane.

  • The guy on the shoulder. He needs to take precautions so this doesn't happen. Same as exiting your car from a parking place. You just don't fling your door open. You wait unyil it is safe to do so.
