I agree. If the ring is given and accepted as part of a contract to get married, then the giver of the ring is legally entitled to get it back. If it's only given as a token of affection, with no definitive plan to get married, then the receiver can keep it.I understand in some states it also depends on how/why the engagement is being broken. If the woman cheats, for example, the man is entitled to get the ring back. Similarly, if the man cheats, then the woman can keep the ring. Both of these may be legally considered reasons for breaking the contract.As a general guideline, in most situations, a woman usually gives the engagement ring back to the man, regardless of how it was initially given or why the marriage is called off.
