Tort reform is unconstitutional regardless what a judge says, it's clearly defined in the constitution. Tort reform caps the amount a victim can sue for should he or she be injured by a doctor or medical staff regardless how negligent the case may be. Texas for instance caps law suit amounts at 250,000. This means victims can't get anything above that amount 250,000 in damages and no amount is awarded by a jury of their peers. When the unfortunate need arises for victims to sue, they can't even get an attorney that will touch their case, attorneys tell victims the attorney fees along will cost more than 250,000 just to prepare the victims case and attorney's won't even return a victims phone calls.

And let's say the victim decides to sue on their and represent them self. Should the victim be brave enough to try that, it would be nothing short of a guarantee the victim will face a well seasoned attorney if not a group of them on the defendant's side in a court room to end up losing their case for sure. And then no only does victim lose out of the badly needed 250,000 just to pay some of their medical expenses, in Texas, Texas also has in place whosoever losses their case must pay all the defendant's court cost including attorney's fees. In Texas it's not the jury but a rigged system.

Tort reform isn't about thriveless lawsuits as it was claimed, it's about financially protecting the greedy that wrongs others whether they've maimed, negligently injured or deliberately caused someone's death. The state of Texas got tort reform passed by using trickery in order to make voters to vote on it. Now there's basically no malpractice laws suits in Texas pretty because no victims can obtain attorneys anymore.
