How come mental health illness is used as a clutch to excuse criminal behavior?

I know this lady who is 62 years old and just going to prison. Officers never arrested her, but allowed her to do criminal activity upon others. She caused harm to her daughter, but officers never arrested her. The police department would always arrest the daughter, and tell her its her fault. She committed all sort of financial crimes, and etc in the community. Police told others that she's mentally unstable and has a borderline personality. They watched her mess up people lives for years, and never sent her to a mental health facility at all. I'm tired of people using mental health as a clutch to excuse these type of behaviors. She did a lot of crap to people. She even harassed police officers and stalked them down. It took a new chief to actually send her to prison along with other police departments. The only thing people kept hearing was "she have a mental illness and doesn't understand her behavior is wrong".
How come mental health illness is used as a clutch to excuse criminal behavior?
