Okay, the bail is crazy low for the severity of the crime. His bail should be several hundred thousand if not millions. If he is released it should be with an ankle monitor so he can be tracked. That being said, he is still just ACCUSED! He has not been convicted of any crime, therefore we must accept his innocence until he is convicted. It is not our position as the public to try and convict him. It is up to a judge and jury. As an innocent man we must respect his right to bail. This issue was fought in court and that is the figure that the judge decided on. Do I think that he should be released, no, but I also respect the legal system enough to accept it's decision. There maybe a number of factors we simply jist aren't aware of.
And if he hurts or kills someone whilst on bail? Wouldn’t it have been better to just hold him in prison until he’s proven innocent? I think so b
It is unfair and unjust to incarcerate innocent people. That is why we have the bail system in the first place. Until someone is convicted they are innocent. We always must assume innocence, and treat people that way. It is not only a legal standard it is also a standard of fairness. As scientifically it is impossible to prove a negative (you can not prove something false, you can't prove something didn't happen, you can't prove something does not exist) you can only prove that something is real, therefore the burden of proof must lie on the state. Because one can not prove their innocence we must prove their guilt. To incarcerate someone "just in case" is a very slippery slope. Under that standard anyone is subject to incarceration under anyone else's accusations. I do not want to live in a world where someone can punish someone because they said so. That is the absolute nature and definition of privilege. (Literally private law, law that only applies to a select group). To rail against privilege then to accept accusatory incarceration is simply hypocritical.
No, they are PRESUMED innocent. I would rather live in a world where killers and rapists and other abusers were held in prison, away from the public and victims, until the trial concluded and they are found innocent or guilty. To me, that’s more important.
pre·sump·tion/prəˈzəm (p) SH (ə) n/Learn to pronouncenoun1.an idea that is taken to be true, and often used as the basis for other ideas, although it is not known for certain. If it taken to be true, then we must treat the people as if it is true. It is unfair to lock innocent people up. Again that is WHY we have bail in the first place. Also I agree that the bail is very very low for the severity of the crime.
Oh that "learn to pronounce" came from the online dictionary not any statement on my part...
Is it unfair if it puts the populace at ease, if it can protect other people? I don’t think so. That idea has gotten people hurt and killed. I know lol it happens
Also innocent people have been incarcerated, and lost everything due to a misunderstanding or mistake. And yes, that happens as well. The Innocence project suggests that up to 15% of all people who have been convicted are actually innocent of the crime that they are incarcerated for. That number increases when you include those who have not yet seen a judge. And the standard that you mist look at is if it was me that was wrongly accused how would I want the legal system to work. If it was a close family member or even a good friend how would I want the system to work?
So I guess we are at a cross roads then. I value public safety, you value the presumption of innocence.
I suppose so...Agree to disagree?
Sounds good to me :)
It sounds like their going to let a criminal run free , this is why so many peopleend up dead cause the laws just aren't right.
He could possibly be a threat to society
I would assume so
I don't know much , i would think he be on probation ( parole)
Rape is disgusting. Glad the rapist was caught. That said, I have no faith in what is currently the 'justice system' When there are people, there will be bad people.
To your update:-I am not surprised. Crimes against persons - if those persons are women - are not taken seriously in the system.Crimes like this shouldn't warrant bail IMHO.
Set him free but cut off his dick, first!!
Unbelievable he could get out on bail
system is horibly broken
These people should be jailed lifetime
Bad shit happens
