Isn’t it common sense for them to move if they can’t stand my toddler running, crying and playing?

My neighbor banged on my ceiling because my toddler was running and my toddler is only 1, we’re going to court for this. He did this and it was only 2 days into moving into my new apartment. He’s been here longer and did this shit to other tenants I’m sure based on what management told me. The thing is if he can’t stand it why live on the first floor? Why not move into another apartment somewhere else? It makes no sense to try and make everyone miserable because you live underneath them. Common sense is to get an apartment on a higher floor with nobody above you.
