The only emergency that overrides the Constitution is the need to punish a criminal who break a legitimate law that does not conflict with the Constitution. If a law conflicts with the Constitution, the Constitution wins.

@Ad_Quid_Orator In the eyes of the law it is not there is no duty to protect another the famous saying is if you see a child drown you can watch him drown and not attempt to save his life and you won't be guilty of any offence.
But there is a law not to punch someone in the face just as there is a law not to spread germs to them.

@Ad_Quid_Orator There's no law to not do something but this would be battery yes but for battery there must be a mens rea and an actus reus the mens rea is proof the person intended to transmit the disease or punch someone which is impossible but also people are more likely to just want to go outside than kill anyone. Actus reus is evidence for the actual act which again is impossible because you can't prove A had the virus and transmitted it to B in that time frame.
But the point remains that you're putting others in danger; you can't keep a tank of poison gas on your property because of the risk that it will rupture and endanger public health and you can't gather in large groups because of the danger of spreading coronavirus.
@Ad_Quid_Orator Well the tank of gas is different and would fall under COSHH plus other things but when it comes to human to human contact the law is you have no obligation to help anyone if you do help someone and they get hurt more though you also won't be liable for it.

@Ad_Quid_Orator Actually some weeks ago in New York they literally had the military out in the streets forcing people. You Werner allowed to even leave unless it was legitimate. Their cars were everywhere and they were prepared. Social distancing should be common knowledge. By infringing peoples rights and giving them fines & forcefully telling them when they are even allowed to leave their parking lots is a violation of our rights. If they don’t like it then they can leave. Everyone knows to social distance.
Over most of the country the military isn't forcing these rules and while social distancing is common knowledge that MOST people understand, when it comes to communicable diseases, it only takes a few self centered morons to violate social distancing and fuck it up for the rest of us.

There were other measures taken to enforce social distancing and they adjusted for other factors that impacted mortality.

Also, (unlike in 1918) social distancing can buy time until a vaccine is developed AND we don't have to maintain the same level of restrictions until then because having contracted the virus, there will be a portion of the population mostly immune to re-infection and they can work jobs that would otherwise put people at an unacceptable risk of infection and subsequent spreading.
