Does / should it matter what TYPE OF ALCOHOL OR THE SIZE OF CONTAINER?

If you are supervising your own kids does that change anything?

Does the drinkers walking / mobility or being stationary change the equation?

Are there any other ancillary circumstances that in conjunction with drinking in public rise to the level of a crime? Ticket? Fine?

Is this just another anachronistic ridiculous moralizing holdover of "Sunday Blue Laws"?

*Some jurisdictions where this is illegal vendors provide a paper bag for you to cover the beverage that way their customers don't have any problems.
