Let's say I was 50% black and 50% white. I could choose to identify as either, or neither, right?
what if one grandparent was black, 3 white, so I was 1/4 black. While I might want to acknowledge my black heritage, it seems obvious I would identify as white (unless I was born with darker skin and considering myself black, based on appearence was easier.)

but at what point would I no longer be black? would any black heritage be so watered down that it either would not occur to me to identify as black at all, or that, if I did want to, I would have society tell me "no, you are white, and identifying as black, even if you have a trace amount of black heritage, is offensive to REAL black people?"

I'm asking this because of a recent news story. A girl, 6 years old, has been taken from the foster family that has raised her since she was a year and a half old. She loves them, they were in the process of trying to formally adopt her.
Why was she taken from them?
A law exists that says that, whenever possible, Native American children should be placed with Native American homes, or with family, in order to combat the destruction of Native culture. And when you consider the number of Native kids who were raised in non-native households, it might even be argued that the law was well intentioned and even needed.

This girl is 1/64 Choctow Indian. That means ONE of her great-great-great-great grandparents was full blood Choctow. Six generations ago.
The fact that 1.5% of her heritage is Native American heritage makes her, legally speaking, a Native American. And that means a law is being violated by letting her be raised by white people.

Oh, here's the kicker: The people she is being moved to live with? NOT Natives. They are related to her father through marriage, but are not Natives or part of any tribe.
