Judge makes thinly-veiled attempt to silence Trump during rape trial, advising parties against statements that could 'incite violence'

The judge presiding over a rape claim lawsuit against former President Donald Trump on Tuesday made a thinly-veiled attempt to stop Trump from publicly commenting on the case.

Opening statements are expected to kick off today in E. Jean Carroll's defamation and rape lawsuit against Trump. Trump has denied her allegations and was absent in the courtroom as the jury was selected on Tuesday in Manhattan federal court.

Before potential jurors were brought into the room, US District Judge Lewis A. Kaplan asked attorneys for both sides to advise their clients against "making any statements that will incite violence or civil unrest."

Kaplan said the warning was not meant to accuse either side of misconduct, but in order to "try to avoid problems down the road."

As of 2:30 p. m. ET Tuesday, Trump had not weighed in on the case on Truth Social or Facebook.

When reached for comment, Steven Cheung, commications director for the Trump campaign, issued the following statement:

"This latest fake case has no merit or facts and is just another part of the witch hunt targeted to interfere and tamper with a Presidential election. The radical, deranged Democrats will stop at nothing in order to prevent the American people from choosing President Donald Trump— the overwhelming front runner by far— as their 47th President. The lunatics will fail and President Trump will Make America Great Again!"

Capitol rioter shot at local deputies after FBI informed him of Jan. 6 charges

A Texas man facing charges in the Jan. 6 riot opened fire last week on sheriff’s deputies who had gone to his home to check on him ahead of his scheduled surrender to the FBI, according to a new criminal complaint.

Nathan Donald Pelham, of Greenville, who initially faced four misdemeanor charges tied to the insurrection, faces an additional felony charge of being a felon in possession of firearm after the incident April 12, a criminal complaint filed this week shows.

An FBI special agent wrote in a filing that he had called Pelham on April 12 and asked him to surrender in a few days. That evening, according to the agent, local authorities went to Pelham’s home after his father requested a welfare check.

When the deputies arrived, Pelham fired several shots toward them, prosecutors said.

One of the law enforcement officers said one gunshot “came in so close proximity to myself that I could hear the distinct whistling sound as the bullet traveled by me and then strike a metal object to my right side,” according to a court filing.

The new weapon charge against Pelham is likely to give federal authorities a quick way to keep him locked up before his trial. He could face other charges related to the shooting down the line.

Court records show that Pelham waived a detention hearing and that a federal magistrate judge ordered him detained.

The initial charges included disorderly conduct and parading, demonstrating or picketing at the Capitol. He appeared in at least one photo from the riot donning a hat with a logo associated with the Proud Boys, the FBI said.

New Yorkers boarding subways for their morning commute in 2010 were met with an unusual sight: anti-abortion advertisements, portraying a young, hip woman whose decision to terminate a pregnancy had unalterably marred her future.

“I thought life would be the way it was before,” the ads read, set against a somber portrait of the woman. “I wonder if there was something I could have done to help her,” another one said, showing a man looking solemnly at the floor.

The advertisements, which reportedly numbered 2,000 in the subway system alone in addition to billboards and print ads, all promoted the same website: AbortionChangesYou. com, which offers “healing” to those who’ve been “touched by abortion.” The site features a page where users are invited to read and anonymously write testimonials about the effects of terminating a pregnancy, such as “feeling far away from or angry toward God.

Later in his order, Kacsmaryk referenced the same study again, falsely referring to multiple “studies,” rather than just one, that he said “show eighty-three percent of women report that chemical abortion changed them and seventy-seven percent of those women reported a negative.” As the study’s authors have repeatedly stressed, this may not be surprising for entries to a website called “Abortion Changes You.”

Critics of Kacsmaryk’s ruling have pounced on the study’s inclusion in his order: The New Republic called the study “completely bogus,” and Adam Unikowsky, who had been a clerk for the late Supreme Court Justice Antonin Scalia, observed, “This is roughly like reporting a statistic that ‘83% of people are fans of Judge Kacsmaryk’ without mentioning that the entire sample consisted of posters on JudgeKacsmarykFanClub. com.”

Donald Trump says the staff of the New York City courthouse at which he was arraigned last week were so moved by his presence or the event of his booking on criminal charges that they broke down into tears.

Trump, in his first interview since last Tuesday’s arraignment with Fox News and “Tucker Carlson Tonight,” called the courthouse staff “incredible” and further claimed they apologized to him.

“They were incredible. When I went to the courthouse which is also a prison in a sense, they signed me in and I’ll tell you people were crying,” Trump told Fox News. “People that work there. Professionally work there that have no problems putting in murderers and they see everybody. It’s a tough, tough place and they were crying. They were actually crying. They said I’m sorry.”

It was unclear what courthouse staff Trump was referring to. As part of the widespread media coverage of the arraignment, Trump could be seen being led out of a doorway of the courthouse into a hallway, heavily surrounded by uniformed law enforcement. Trump wore a sullen, serious look as the law enforcement officers escorting him maintained emotionless expressions.

Trump was charged with 34 felony counts related to an alleged hush money scheme to cover up extramarital affairs leading up the 2016 presidential election.

“The defendant, Donald J. Trump, falsified New York business records in order to conceal an illegal conspiracy to undermine the integrity of the 2016 presidential election and other violations of election laws,” Assistant District Attorney Christopher Conroy said.

As a former president and the de facto leader of the Republican Party, Donald Trump is one of the most powerful people in America.

But as a criminal defendant within the confines of the Manhattan courtroom where the case against him will play out for months to come, Trump is under the authority of someone else: the presiding judge, Juan Merchan.

The two men came face-to-face Tuesday, after prosecutors with the Manhattan district attorney’s office unveiled 34 felony charges against Trump. When the prosecutors raised some of the former president’s recent social media posts, including one warning that “death and destruction” could follow if he were charged, Merchan asked that Trump refrain from making comments that were “likely to incite violence or civil unrest.”

But after the hearing, Trump returned to Florida and to his old habits, calling the district attorney, Alvin Bragg, a “criminal,” and Merchan “a Trump-hating judge with a Trump-hating wife and family.”

Merchan’s warning and Trump’s reaction later that evening provided dueling examples of what will almost surely be a delicate dance. The former president, who is running to take back the White House, will have to appeal to a political base that feeds on his unrestrained rhetoric without crossing a line that might cause the judge to take action against him.

Former President Donald Trump’s expected appearance Tuesday in a Manhattan court is a volatile moment for the country with an unpredictable outcome, but law enforcement officials have not yet seen indications of a disruptive, organized backlash akin to the Jan. 6, 2021, attack on the Capitol.

The New York City Police Department, state law enforcement agencies, the Secret Service and the U. S. Marshals Service have been coordinating efforts, while increasing intelligence gathering and mobilization. The police, for instance, sent a stand-ready order to about 35,000 officers, a force larger and better trained than some national armies.

Even as Trump’s coming arraignment reflects a different set of circumstances, the response is informed by lessons learned from the Capitol riot and from the challenges posed by the nationwide protests against police violence in 2020. They include the need to deploy forces quickly when threats pop up on social media, and the importance of sharing intelligence among agencies in real time, officials have said.
