Because "DOGE" is not an actual department under the Executive Branch and that has to be created by law.
Since it is not real, no one has taken an oath which Federal employees do. It's basically having unelected people in positions of power that they should otherwise not have.

That said, the idea of an independent organization finding ways to alleviate waste is a good idea.

D-as-in-department OGE, if it is to be a "department" and official part of the Cabinet, then it needs to be created by Congress and have its administrator confirmed by the Senate. (And, furthermore, the succession order would have to be updated to include the Secretary of Government Efficiency.)

That said, "DOGE" had already pre-existed. It is simply a renaming of the US Digital Service. However, apparently, it is also a repurposing of the service. And, no matter what Trump may say, it's not actually a "department" because of the legal ramifications of departments.
