The 20th amendment states that on noon of January 20th the newly elected president takes power The former president is a civilian as of noon and a trespasser in the White House unless staying as a guest of the newly elected president. Any president refusing to leave is subject to arrest.

A law that you cannot enforce is not a law at all. It's just a wish. So far the history with Trump has been a series of laws that went unenforced out of fear of him and his money. Until that changes which I don't see happening anytime soon he is going to continue breaking every law he can and he's going to do that with impunity.

I'm not exactly sure how this is going to work, but I think that the newly elected President will be one of Trump's minions or will simply ignore the fact that Trump continues to be in the White House. I'll be really anxious to see who it is that's actually going to go in there and physically remove Trump, because I don't think that's going to happen. Perhaps Trump's lawyers will file all sorts of paper at the Supreme Court and get them to extend his stay in the White House until they can adjudicate it, which might take a year or two.
