Guys, Would you pursue a girl even if you're friends with her sister?

I'm in this situation. I like a guy he's sort of friends with my sister (she's moving country soon and has a boyfriend who she's happy with)

And he asked me to play at this festival and said he'd join I feel he's made a few small moves to test the water. That's what I'm feeling. I wondered however if the dynamic made it weird. He is friends with my sister, so he's just over four years older than me

Does everyone abide by that code? Last time I saw him I was with my sister. He kept making eye contact and seemed nervous. Then he struck up a conversation with me and we were talking for a good while. He seemed interested in me... So I don't know if it bothers him. Maybe it does. But I know my sister doesn't mind.
