Yes, it's hella common. And who's MOST at fault? First the government, next the crazy society that kept voting it into power.
Why the government?
1) Education. Yes, we all want freedom. But what is responsibility? We learn freedom, but we don't learn responsibility enough.
2) Enforcement. The government feared being voted out. Hence not enough punishment is given to irresponsible ones so that others can learn. Hence society decay.
And yes, the crazy society.
3) when the government does what is right, but apparently "inflinge" on certain "rights", they stop supporting.
Typical example is guns control, and this question.
Which is better? Self defence or no need to defense if no one carries gun? Or low divorce rate due to infidelity vs current high rates?
I'm not into debate. Statistics shown enough for thinking person to pick the better choice, as manifested in countries outside the West.
Conclusion: yes, people are at fault. But those are like symptoms of a sickness. The root cause has to do with education and legal enforcement on Laws for the betterment of society.

The person who was married knew that they were married, and they took vows. The unmarried party took no such vows, and may not even have known.
What if they did know?
They still weren’t the ones who took vows. That said, their behavior is unethical. But the behavior of the married party is more unethical.

Both sides are at fault and jerks, but the married person is the biggest fault and jerk for not only having sex with another person but also for betraying their spouse's trust.
