They could but you are not likely to have charges pressed against you. They would have to know the exact dates and times and amounts for a DA to even consider it, and that after you will have voluntarily come back and paid restitution.. Why would a DA waste his/her time with this? But if the DA did, it would then require convincing a jury and/or judge that a person who voluntarily paid restitution is worthy of punishment. The reality is that it is almost certainly not going to get past the second phase.
