But, you need to understand something...

There are two elements to a crime:
1. Actus Reus - which is the criminal act.
2. Mens Rea - which is "having a guilty mind"... that you know you are doing something wrong.
Without both elements, you do not have a crime.

Documents found at Biden's residence and Pence's residence perhaps should not have been there.
But that doesn't necessarily signal criminality.

Neither for ex-President Trump.

The BIG difference between Trump and the other two men is OBSTRUCTION.

When Trump started going through this issue, that was a wake-up call to others to check.

Biden's team found the documents he had before anyone was looking for them and they alerted the authorities about it. That's definitely not mens rea, so no crime.

Something similar happened with Mike Pence, Trump's GOP VP. Again, no mens rea, so no crime.

Trump, though, his big problem was that he was told by the National Archives that he had documents that needed to be returned. Trump was President so, with his administration ending, the National Archives did what it always does during the change of adminstration to follow the Presidential Records Act.

Trump took whatever he took and I can cut him slack on that.
But, the moment the National Archives let him know, it was his obligation to give them whatever they requrested. He did not at first. And then he only gave some. And then his team said they gave it all but didn't. So, the National Archives contacted the Department of Justice who got the FBI to take action. Thus Mar-A-Lago was raided in August 2022 to retrieve documents.

Trump's actions indicate some form of mens rea, so that means a crime may have been committed.
He should have fully complied with the National Archives immediately... or simply have them do it.
All previous presidents always oblige the National Archives on this issue and begin complying with the Presidential Records Act before their administration is over.

He must have known it was illegal to take the documents. He was not the president so he did not have the ability to declassify documents the way a president did. I heard he had documents that he took while he was in the senate and he would not have been allowed to take the documents off the premises. President Trump had the foresight to do that. He probably anticipated that the democrats would try to do exactly what they did so he declassified everything before he took it.
