It seems like the supreme court lets a lot of cases go to a lower court to rule first, I think they like to see what legal arguments they make. I don't really know whether I think that's a good idea or not in this case since it's so close to the election.

My favorite recent YouTube videos were actually from MSNBC. One was about Jack Smith demanding the Supreme Court fast track Trump's trial. Then like two days later was the follow-up video of the Supreme Court swatting away Jack Smith like a fly. Like MSNBC actually thought that the Supreme Court was going to genuflect or answer to Jack Smith. 😂

Yeah I am actually thinking something similar as I said in my comment I think they want a lower court to rule on this. Then they can at least see what legal arguments they use and if they decide not to take up the case the lower court ruling will stand.
