I agree, Washington D. C. is a federal district which congress has Exclusive legislative authority over Congress per Article 1 Section 8 clause 17.

That means there is no legitimate law in the District of Columbia which isn't passed by Congress.

Thus the 2nd amendment's explicitly language prohibiting congress from making any law abridging the right to keep and bare arms doesn't make exception.

As such the District of Columbia's law to do so is on face value unconstitutional.

I disagree with the later case McDonald v. City of Chicago (2010) which attempted to extend this to the States. Who's legislative authority is NOT exclusive to congress.

Just wanted to add my own point that the idea of the 2A was that the ability to form a militia was believed to be necessary and that's why people needed to own arms. If they can't, then they can't form militias. Especially in those days where arms distribution would be incredibly slow.


The self defense argument is completely separate and this case in the post is a fair ruling, in my opinion. I consider self defense a basic human right, and not everyone can be a large/strong person with martial arts experience. Or, even if they are, able to fight off a group off attackers, armed or unarmed. So, it's only right that the average person have a means for leveling the field a bit.

The Heller decision specifically states that the right to bear arms is not limited to service in a militia, so Burger and anyone else making the argument that it is based on their literal reading of the Second Amendment has been overruled, so to speak.

It is literally in the constitution, Article 1 Section 8 Clause 17 puts the district of Columbia under the EXCLUSIVE legislative authority of congress. Therefore any gun law to exist there must be passed by congress. Well the 2nd amendment explicitly bans congress from passing any gun laws.

Ergo the District of Columbia cannot have gun laws. Doesn't much matter as D. C. can be no more than 10 by 10 miles or as small as you like.

The case of consequence we can disagree with is 2 years later McDonald v. City of Chicago (2010). Where the same court tries to impose congress's limits upon our State & local legislators.
