It depends what they say. Some comments can be more extreme than others. Also an important factor is was the team member intentionally trying to disrespect the USA because people can and do have different perspectives about what is disrespectful and respectful.

No. It should not be a criminal offense. Negative public opinion would be punishment enough if the public disagrees with their stance. They may also lose sponsorships.
