It is perfectly legal for Elon to hire asylees at Tesla. But because of the sensitive nature of rockets and weapons technology, it’s a federal crime to hire asylees at SpaceX. It is legal to hire US citizens and green card holders.
So because Biden was upset that Elon wouldn’t break federal law, Biden sued him.
The case was eventually dropped by the justice department.
