The plaintiff got into a car accident and her partner were driving home from a bar after throwing a birthday party for her partner. They turned sharply and caused a rollover accident. The plaintiff survived but their partner died in the accident. The brake line was corroded and frayed and the cop said at one point while tailing the plaintiff's vehicle, the car visibly slowed down but then didn't slow down anymore even though the brake lights came on. She was below the legal limit then. And the defendant (the plaintiff's ex) is being charged with second degree murder and attempted second degree murder. He admitted to being on the scene, hoping to extend an olive branch. However, he decided against it and was only there for around two minutes before leaving to finish cleaning up at his family's auto shop. The cop found a brake line cutter in the shop, but didn't bother to test the liquid surrounding it and assumed it was brake fluid.

So, in principle, the Prosecution can't even call the Defendant as a witness. To be a witness, the Defendant volunteers to do so - usually after consulting with his/her lawyer who would first call the Defendant as a witness and then the Prosecution will cross-examine.

No. If the defendant DOES choose to testify in his own favor, he is subject to cross examination. If he refuses to testify, he isn’t.

It's exactly like all those "Fifth" responses from all those witnesses under oath in the January 6th Committee hearings.

I am open to the fact that I may have waived my 5th Amendment rights if I take the stand. I've done some researching at various legal sites and one implies that I have lost that right once I take the stand in my defense.

In most cases the defendant does not testify, too risky. It's up to the prosecution go prove their case, and the defendant testifying helps that in most cases. I'd have a serious discussion with your lawyer about why they want you go testify.

The cop was also promised to be appointed chief and the plaintiff is the mayor's daughter. She has a history of driving drunk, but her daddy would keep her out of legal trouble. The defendant has a criminal record of two misdemeanor vandalism charges. Several of the witnesses said the defendant was only in the bar parking lot for about two minutes, which isn't enough time to cut a brake line in the dark without being seen. The decedent was wasted and laid down in the backseat of the car presumably without a seatbelt. An attorney will attack her with that in the cross exam

So a 404(b) would be brought up to introduce the other charges, if denied it can’t be brought up. The case sounds like it is based around circumstances. If the decendant was drunk then that points in the direction of a DUI. The promise for Chief shows motive for malicious prosecution, which is a legal term. Malicious prosecution is intentionally fabricating evidence or making someone you know to be innocent to face charges, motivation being the cop’s promotion, and the mayor having a reputable family name. The car should be inspected for sabotage by a professional, who’d provide testimony.

No, I believe that's false.

Even testifying, he can still invoke the 5th Amendment.
That's exactly what happened in the video that I displayed - each of those traitors... excuse me... witnesses... were "sworn in" when having given testimony - they were "under oath" - yet they exercised their 5th Amendment rights against self-incrimination.

The affidavit you provided earlier is akin to an acknowledgment of Miranda rights that will go into the record.

This part: "[I[ am voluntarily waiving [my rights protecting against self-incrimination] by testifying at trial" is bullshit.

You can take voluntarily take the stand and be cross-examined, but you never surrender your 5th Amendment rights - even under an affidavit.

If the Defendant's lawyer made him sign this, the lawyer should be fired and, worse, if the defendant is convicted, his lawyer's incompetent counsel is grounds for an appeal. An appellate court would recognize such egregiously incompetent counsel and they would vacate the conviction and generally order a retrial.
