I'm not sure what you mean by "not legally separated." In some states, a separation is a preliminary to a divorce so, if they are not even separated, that means they are not divorced. And if she is still married to the first husband, she cannot legally marry anyone else until that marriages ends by divorce or death. If she lies about her marital status for the purpose of obtaining a marriage license, the second marriage will not be valid despite the issuance of the marriage license.

It would be a problem to "marry' a woman who had no legal separation or divorce as I think that is called 'bigamy" and any marriage would not be recognized as legal, since she is "legally' married to another man.

I know this was probably meant for guys, but personally I think I would be afraid of what he might be capable of. I wouldn't want him to come after me for being with his ex wife. Besides, how could I marry her if she technically isn't divorced?
