Can I sue for this action?

A guy tried to fight me the other night because he was told that he should beat me up because he likes an old girlfriend of mine and when my name was brought up at being better than him he was told by my old girlfriend’s bestfriend that I should get beat up for that being said. Needless to say I’m at a bar with a friend and he tries to goad me into a fight. I decline and ignore him until he hits me in the head with a glass bottle. Needless to say he got his ass beat. I saw his phone go off with a text message from the girls best friend. I sent the pictures of the entire conversation to myself. I wondering if I should sue the two parties for that but I am not entirely sure

Him for assaulting you, and you for spying on and stealing private information.

Plus you were both drunk.

I’m the one who won the fight. The only hit he got on me was the bottle to the back of my head.

How is it spying if I take his phone to send information he would eventually delete?
