Race is a biological term, so is breed, so is cultivar, so is variant, and there's reason for each term even though they all describe an instance of speciation. Another name for race is subspecies, it's just a shorter form.

There's also an old anthropologic term that's vague, used to describe what today we would call an ethnicity or a group of ethnicity with a huge cultural weight, but I don't care about this term.

But they should be applied narrowly and only when the perpetrator truly hates the victim for their race gender or sexual orientation (or some other protected class, if the statute allows).

But this is only my off the cuff interpretation. I’m not a criminal lawyer and I really haven’t thought about this issue that much.
