Why does society want to keep severe mentally ill people out of prisons instead of punishing them for their crime in prisons and jails?

Cannot say for other countries, however on the whole if a person is deemed to be a danger to themselves or others they end up sectioned under the mental health act.

while there are mistakes made with people being either released or initially been viewed as a risk, it by and large does work.

a lot of these people are never released and will die in these institutions.

When you consider a 19 yr old person that commits murder could be out in 20 years, a person sectioned under mental health act for even attempted murder may die in that institution.

Well, it’s the age old belief that we all have free will. So, if you don’t have some debilitating mental ailment, then you must’ve acted out of free will when it comes to the committal of crimes.


If this is the case, then prison is the appropriate place for one that acts out of free will when committing a heinous crime, whereas those with some mental ailment cannot have acted out of free will.


In essence, their minds were hijacked or taken over outside of their free will.


A lot of the justice system seems to act out of the belief that free will is a real thing and it exists in human beings.


It allows for the allocation of responsibilities, rewards, and punishments.

Because its not right to punish
someone with jail time for something they have no control over, or lack the understanding required to prove intent.
These people need help, and a lack of mental health resources contributes to people going around undiagnosed and unmedicated.
They should, of course, be separated from society if their behaviors are a danger to the rest of us. But putting them a regular jail isn’t where they need to go.
They need specialized care that jail guards are not trained to deal with.

Those with severe mental illness who commit serious crimes are not just set free, they are committed to institutions which are often a lot worse than the prisons and they may be held there indefinitely.

What society needs to do is to provide mental health care to people with issues before they get to the point where they end up committing a crime.

It’s not out of prison so much as in asylums. Treated so they don’t get worse. Worst thing for prison guards would be to make him manage a schizophrenic untreated.
