to define it may not be so easy, no wonder she dodged it.
but to make a reasonable determination seems obvious.

for a supreme court judge... the goal is to not answer questions, "check their recollection", avoid answering and dodging questions. that's how you get the job.

if only all job interviews were like that... here's an example hiring a plumber.

patron: "so you are a plumber and can fix my leaking pipe?"
plumber: I've plumbed stuff... I got a sign on my truck. "fix" is a complex question I'll have to take into consideration"
patron: "that's good enough for me, you're hired for life!

Well its like anything, it depends how well you want it to be defined.

If it is just for your own purposes then you are probably equipped well enough to make your own definitions.

If however you need a robust legal definition then you will need a judge and a courtroom a huge amount of time and a host of experts from various fields and you may well need to revisit the subject again in the future when new perspectives and evidences etc become available.

I've watched a few of supreme court nominition hearings, Roberts, Sotomayor, Coney-Barret and it seems a lot times they don't give answers to some of the questions. I've heard they're coached not to answer questions that they think could interfere with a future case, but I thnk really they just don't have an answer for the questions, lol.
