Yes, but despite Biden's best efforts, we DO still have due process in this country; someone is not made a criminal simply because you declare them to be. If you have evidence, arrest and charge him.

"Treason", however, is defined as "giving aid and comfort to the country's enemies", not "being a jerk", so if you want to be fair, you're going to have to go after the guys undermining the Constitution before those saying nasty things on social media.

In America treason requires two eye witnesses or a open confession. So they cleverly brought in sedation and espionage acts which make it easier to get a conviction. Punishment for treason can include death and its fair to say if trump's actions were shown to risk American lives the death penalty could seriously be considered

In theory. But the justice system here is beyond fucked, dudes spend their lives in prison for owning a plant where as a guy who was caught raping a woman by other people and had to be pulled off her got off scot free minus a couple weeks in a local jail.
