And in court, where facts matter. I think this case is just about the fact he had documents he shouldn't have, and knew he shouldn't have had them. The fact that he shows them to people without security clearance or a need to know is a whole other crime in another state. He refused to hand them back to the government when they asked, and even when they insisted via a subpoena. He hid them from and lied to his own lawyers so that they would pass on misinformation to the government. The documents weren't kept in a safe place, at one stage they were behind a curtain in a room used by guests to Mar a Lago.
