Based on how the hearing committee has taken testimony from people under oath to this point? No. You can't prosecute and convict a person of a criminal offense using hearsay and lack of cross-examination. It's not proper due process.

This isn't a trial and never was. They are showing the evidence. The justice dept. can indict and then it would proceed from there.

Yes it's a congressional hearing and not a trial. However if the goal of this process is for the Justice Department to eventually bring an indictment and have a criminal trial, then what they're currently doing is just a pointless show. Hearsay isn't admissible or reliable evidence in a criminal trial, and those currently offering testimony under oath and under the threat of Perjury and/or Contempt Of Congress are supposed to be challenged (cross-examined) to determine the validity of their statements.

Ultimately Merrick Garland will decide if the Justice Department will bring an indictment based on what they're doing, but they need to present the Justice Department with actual non-hearsay evidence that can't be disproven and/or overruled under due process during a criminal trial. The hurtle for conviction in a criminal trial is "beyond a reasonable doubt" (99.99%+), not "preponderance of the evidence" (greater than 50%) as it is in a civil case. As of now, nothing they've done or shown warrants a criminal indictment.
