Do you believe her family has the right to sue the government for her death when she was committing a crime?

The family of a woman who was fatally shot by a police officer during the Jan. 6, 2021, riot at the U. S. Capitol has sued the U. S. government, alleging wrongful death, assault and negligence.

While this is a controversial issue, my belief is that if you are involved in committing a crime and are killed in the process, then that is on you and not the police office that shot you.

What are your thoughts?

Absolutely.

The sad truth is, in america its normal to get shot by cops. But usually the cops shouldn't be allowed to just shoot people unless there are really extreme circumstances, eg when someone starts firing at them, or the life of another civilian is in danger...

So yes, the family has every right to sue and the cops must explain how using lethal force was to only way out and every other option was exhausted and they had no choice but to use lethal methods as their last resort.

Ashee Babitt was unarmed and posed no threat to anyone. The vIdeo shows other armed Capitol police officers behind Ashlee Babbitt as she tried to climb through the window. Neither did anything to restrain her. There were other Capitol Police officers that moved out of the line of fire before the shooting as if on cue. The officer that murderers her was heard on the radio after the doctor that he heard shots fired and was going to shoot. I think he should be tried for murder.

Of course the family has the right to sue. A bumbling black cop shoots an unarmed white woman with her hands in the air.

But on the flip side, if cops really were allowed to shoot people committing crimes, we wouldn't have many people in prison. Cops could pull up to a smash n grab, and just start mowing them down with assault rifles. We would run out of criminals pretty fast.

@Surely Well, what about due process of law? This is supposed to be a government of law. No one is supposed to be deprived of life, liberty or property without due process of law. That means you're entitled to a trial, and to confront your accusers. And they can't hold you in jail indefinitely without a trial, either. But right now there are a lot of people who have been held in jail for a couple of years without trial! How can that be? Can prosecuters just disregard the law when they feel like it?

In the US legal system, anyone can sue anyone else. They may not win though.

This case would be one considering if excessive force was used. Shooting an unarmed woman just because she is trying to climb in through a window into the Capitol might be considered excessive force... let's see what a jury says. It's important to note that the police, although they carry a gun, are trained to defuse situations without having to use the gun.

Remember that some people in the past were killed while committing a crime that were killed by police. There were people rioting in the streets and burning down the community. The survivors got tons of money and no one was arrested for their protests!

What you don’t get is It really doesn’t matter. If someone broke into your home, would you feel justified in shooting them? You said you would wait until they were inside. Clearly you would feel justified.

I'm against qualified immunity. Shold they have the right to sue? Sure, everybody that gets killed by a cop sues now a days. I can get an indictment on a crippled 6-year-old for faking the moon landing. Doesn't mean a conviction is forthcoming. The standard to initiate a civil proceeding is next to nothing, so yeah, they can sue. We'll see if they get anything from it. Or if the government demands a jury.

Let's be real I was a security guard in college for 6 months and believe the pay and conditions didn't make me put myself in danger, observe and report.
