Considering all the unusual things Joe Biden has done as a lame duck President, this may be his biggest error.

First off, the ERA, by a law passed by Congress, had to be ratified by 38 states, as required by the Constitution, before 1972. That didn't happen, so the ERA is not a valid amendment.

Perhaps more interesting, and more of a serious error by Joe Biden and his advisors, if the ERA was a valid amendment, it would prevent biological males from participating in women's sports, because that would discriminate against females, a clear violation of the ERA. The ERA would negate liberals' support for trans-gender men and women..

There's a long legal controversy over the ERA
The issue has long been the subject of legal controversy. In 2020, the national archivist — who is charged with making constitutional amendments official — declined to certify the amendment, citing an opinion from the Justice Department's Office of Legal Counsel. The department said it considered the ERA to be expired after a 1982 ratification deadline was missed. In 2022, the Office of Legal Counsel released an opinion affirming that 2020 decision.

So no. No decree. An opinion with no force.

Based on what's in the link:

1) He did not decree it (the president has no such authority anyway)

2) This is likely to get tied up in the courts.

3) My personal guess is that unless the courts see it as a political issue and refuse to touch it, they will rule that the amendment was not properly ratified.

He didn't decree it. It was ratified by Congress and the required 38 states. Virginia was the 38th.
